Victim/Witness Assistance Program

The 6th Judicial District Attorney’s Office is committed to protecting and enforcing Victim’s Rights. Victim/Witness Assistants (V/WA’s) are here to provide extensive assistance throughout the judicial process and make referrals to community partners to assist with the trauma and burden suffered by those who, through no fault of their own, find themselves to be a victim of a crime.


All victims of crimes shall be afforded assistance by the Victim/Witness Assistance Program (V/WA Program). Our office does not distinguish between enumerated and non-enumerated crimes. The distinction between the two types of crimes is artificial. All crimes can be emotionally, physically, and financially devastating for victims.
Victim Advocates support victims, help them understand their rights under the New Mexico Victims of Crime Act, and keep them involved with their cases as they move through the criminal justice system. Victim advocates are not attorneys, but are knowledgeable professionals who are available to assist crime victims with various needs and concerns pertaining to the prosecution of the criminal case including connecting victims to resources and assisting in the courtroom.

THE CRIME HAS BEEN REPORTED, NOW WHAT?

 

Generally, once the crime has been reported, the law enforcement agency will investigate the alleged offense, and then file the case in Magistrate Court if they have sufficient cause to do so.

  • Depending on the nature of the crime, the case may be Officer Prosecuted, or it may be referred to the District Attorney’s Office.
  • Officer Prosecuted Cases are Misdemeanor Level Cases filed in Magistrate Court.
  • The District Attorney’s Office Prosecutes ALL Felony Level Cases and Misdemeanor Level Cases involving DUI/DWI, Domestic Violence, and ALL cases tried before a jury.

To find out if the crime you reported was filed in Magistrate Court, you may contact the officer who took your report, contact the Court of Jurisdiction (Look up the case on NM Courts), or call the District Attorney’s Office and ask to speak with a victim advocate.
